2. Children Under the Age of 13

Our Websites are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Websites. information that you provide by filling in forms on our Websites. This includes information provided at the time of enrolling in a course, posting material, or requesting further information. We may also ask you for information when you enter a promotion sponsored by us, and when you report a problem with our Websites;
records and copies of your correspondence (including email addresses), if you contact us;
your responses to surveys and quizzes that we might ask you to complete for research purposes or as part of the course you enroll for;
details of courses that you enroll for on our Website. You may be required to provide financial information before enrolling in a course through our Website; and
your access to the subjects and materials for each course on the Website that you enroll in.

If you refuse to provide such Personal Data or withdraw your consent to our processing of Personal Data, then in some cases we may not be able to enroll you in a course or provide you access to it. 

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Website or transmitted to other users of the Website or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

It helps us to keep track of your progress in a course and provide you a transcript. It also helps us to improve our Website and to deliver a better and more personalized service by enabling us to:

recognize you when you return to our Website.

to allow you to participate in interactive features on our Website;

to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Genius Inc’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Genius Inc about our Website’s users is among the assets transferred;

to fulfill the purpose for which you provide it. For example, if you give us a social media login to post you’re your data on social media, we will use that information to post your data; 
for any other purpose disclosed by us when you provide the information; and

to enforce or apply our Terms of Use and other agreements, including for billing and collection purposes; and

When possible, these organizations are under contractual obligations to use this data only for providing the services to us and to maintain this information strictly confidential. In addition, we strive to provide you with choices regarding the Personal Data you provide to us. We have created mechanisms to provide you with control over your Personal Data:

Promotional Offers from Genius. If you do not wish to have your contact information used by us to promote our own products or services, you can opt-out by clicking the unsubscribe link at the bottom of any email that you receive from us or by sending us an email stating your request to support@geniusinc.com. This opt out does not apply to information provided to Genius as a result of course enrollment or other transactions.

7. Accessing and Correcting Your Information

You can review and change your Personal Data by logging into the Websites and visiting your “Account” page. You may also notify us through the contact information below of any changes or errors in any Personal Data we have about you to ensure that it is complete, accurate, and as current as possible. We cannot delete your personal information except by also deleting your user account. We may also not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect. 

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Website users. Proper access and use of information provided on the Website, including User Contributions, is governed by our Terms of Use .

8. Your California Privacy Rights

California Civil Code Section 1798.83 (California’s “Shine the Light” law) permits users of our Websites that are California residents and who provide Personal Data in obtaining products and services for personal, family, or household use to request certain information regarding our disclosure of Personal Data to third parties for their own direct marketing purposes. If applicable, this information would include the categories of Personal Data and the names and addresses of those businesses with which we shared your Personal Data with for the immediately prior calendar year (e.g. requests made in 2018 will receive information regarding such activities in 2017). California law permits minors under the age of 18 to request the removal of your User Contributions, subject to certain exceptions. If you are under the age of 18 in California, you may contact us using the contact information below (if you contact us via email, please use the subject “California Eraser Law Request”). We may not remove your User Contributions that we are required to retain under any federal or state law, or that have been provided to a third party. While we will do our best to remove a minor’s information upon a valid request, we cannot ensure the complete or comprehensive removal of your User Contributions from our Websites or any information that has been republished, copied, downloaded, or reposted by any third party, and we cannot guarantee that any such information may not be accessible to users of the Internet in the future. We do not advertise or market any of the products or services identified in California Business and Professionals Code Section 22580(i) to users who we have actual knowledge are under 18 years of age.

9. Do Not Track Signals

We do not track you over time and across third-party websites or other online services for any purpose. Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. At this time, we do not honor such signals and we do not modify what information we collect or how we use that information based upon whether such signal is broadcast or received.

10. Data Security

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. Our payment processors use SSL encryption technology to encrypt any payment information. 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted to our Website. Any transmission of Personal Data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. 

11. Consent to Processing of Personal Data in the United States

We do not actively offer our goods and services to individuals in the European Economic Area (“EEA”) at this time and we have not endeavored to comply with privacy laws in the United States. If you are located in the EEA, in order to provide our Websites and courses we will send and store your Personal Data outside of the EEA, including to the United States. Accordingly, your Personal Data may be transferred outside the country where you reside or are located, including to countries that may not or do not provide an adequate level of protection for your Personal Data. If you are located in the EEA and choose to use our Website, you acknowledge and agree that you do so at your own risk and that we are under no obligation to provide you with certain rights that may be available under the laws of the EEA. 

12. Changes to Our Privacy Policy

We may change this Privacy Policy at any time. It is our policy to post any changes we make to our Privacy Policy on this page with a notice that the Privacy Policy has been updated on the Websites’ home page. If we make material changes to how we treat our users’ Personal Data, we will notify you by email to the email address specified in your account and/or through a notice on the Website’s home page. The date this Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Websites and this Privacy Policy to check for any changes.
